Emily's Law, what is it
It is a mandated federal law, that would require all judges to publish immediately upon rendering any and all custody and visitation orders unto the National Crime Intelligence Computer, (N.C.I.C.) Secondly, it would also require a training program for all law enforcement on how to use it effectively as part of the Identification process with all stops so as to actually help stop a parental abduction and the "trafficking of a illegally removed child or children “. Thirdly, it becomes a "enforcement tool" that is much needed today by all police officers and first responders in enforcing and maintaining civil orders involving custody and visitation by verifying an order for the responder, thusly allowing the responder to know in a rapid and live timeframe that a party is violating the judicial order of custody or visitation and making the officer, who is a professional witness, a witness to the civil or criminal contempt making the subject of the interview "subject to compliance or arrest " in a "zero Tolerance" manner.
Why is Emily's Law needed?
The figures are astounding of the frequency of family abduction it’s reported by the National center for missing and exploited children that over 200,000 children are abducted by family members annually. If one takes a look at the pattern of "high conflict divorce" one does not have to look very far to see that these children become not only abducted that is "missing" but have endured abuse physical and emotional and prior to the actual abduction, a trail of police reports and so in short when the police cannot or in some reported cases will not "enforce" a judge’s order, the child endures abuse, abduction or in the very most tragic cases becomes a victim of family homicide. These children need to be protected and the civil rights of the "parent" as well. When are we going to stop denying help to the victim child and parent and actually start making the uncivil parent pay in the forms of fines and jail for this abuse unto a minor?
